No village existed in KDA Scheme-36, declares SHC

According to the news sources, the Sindh High Court directed the provincial government to constitute a team comprising senior officials of the Board of Revenue, Land Unitization Department, City Surveyor, and Karachi Development Authority (KDA) to take on a comprehensive survey of KDA Scheme-36.

A two-judge bench comprising Justice Irfan Saadat Khan and Justice Muhammad Faisal Kamal Alam while giving judgment on old and complicated litigation observed that if it was found that villages were located outside the territorial limits of the Scheme-36, then the Sindh government subject to the final decision of pending litigation in Supreme Court or any other court might decide with regards to occupants of the villages.

In a judgment authored by Justice Alam, the court held that if villages were found to exist in the territorial limits of Scheme-36, then they would be considered encroachment and be removed forthwith.

The court directed the Sindh chief secretary to ensure any intruded portion of Scheme-36 was retrieved immediately in favor of allottees or the KDA.

The court noted that the petitioner Haji Jafer Khan Rind who sought to declare that village Chishti Nagar land in Scheme-36 was legally allotted to various people, suppressed the material facts and judgments of the Supreme Court and Sindh High Court which settled the controversy in an earlier judgment in Talat Ejaz case.

The court noted that the apex court had upheld the judgment of SHC in the Talat Ejaz case which held that no village had ever existed in Scheme-36.

نیوز ذرائع کے مطابق سندھ ہائی کورٹ نے صوبائی حکومت کو بورڈ آف ریونیو، لینڈ یونٹائزیشن ڈیپارٹمنٹ، سٹی سرویئر اور کراچی ڈیولپمنٹ اتھارٹی (کے ڈی اے) کے اعلیٰ حکام پر مشتمل ایک ٹیم تشکیل دینے کا حکم دیا جو کے ڈی اے اسکیم -36.کا جامع سروے کرے۔
جسٹس عرفان سعادت خان اور جسٹس محمد فیصل کمال عالم پر مشتمل دو رکنی بنچ نے پرانی اور پیچیدہ قانونی چارہ جوئی کا فیصلہ سناتے ہوئے کہا کہ اگر یہ پایا جاتا ہے کہ دیہات سکیم 36 کی علاقائی حدود سے باہر واقع ہیں تو سندھ حکومت اس سے مشروط ہے۔ سپریم کورٹ یا کسی دوسری عدالت میں زیر التواء قانونی چارہ جوئی کا حتمی فیصلہ گاؤں کے مکینوں کے حوالے سے فیصلہ کر سکتا ہے۔
جسٹس عالم کی طرف سے لکھے گئے فیصلے میں، عدالت نے کہا کہ اگر سکیم-36 کی علاقائی حدود میں گاؤں پائے جاتے ہیں، تو انہیں تجاوزات تصور کیا جائے گا اور انہیں فوری طور پر ہٹا دیا جائے گا۔
عدالت نے چیف سیکریٹری سندھ کو ہدایت کی کہ وہ اس بات کو یقینی بنائیں کہ اسکیم -36 کے کسی بھی حصے کو الاٹیز یا کے ڈی اے کے حق میں فوری طور پر بازیافت کیا جائے۔
عدالت نے نوٹ کیا کہ درخواست گزار حاجی جعفر خان رند جس نے یہ اعلان کرنے کی کوشش کی کہ گاؤں چشتی نگر کی اراضی اسکیم 36 میں قانونی طور پر مختلف لوگوں کو الاٹ کی گئی تھی، اس نے مادی حقائق اور سپریم کورٹ اور سندھ ہائی کورٹ کے فیصلوں کو دبایا جس سے تنازعہ کو حل کیا گیا۔
عدالت نے نوٹ کیا کہ سپریم کورٹ نے طلعت اعجاز کیس میں ایس ایچ سی کے فیصلے کو برقرار رکھا تھا جس میں کہا گیا تھا کہ اسکیم 36 میں کبھی کوئی گاؤں موجود نہیں تھا۔
