KDA chief told to submit report on three amenity plots in Gulistan e jauhar

The Sindh High Court (SHC) has directed the Karachi Development Authority (KDA) director general (DG) to submit a report after ascertaining whether three amenity plots are situated in Gulistan-e-Jauhar Block 3-A are being used for amenity purposes or not.

The direction came recently on a petition against encroachments on the amenity plots reserved for the purpose of the mosque. The high court had on a previous hearing also directed KDA officials to verify the documents produced by some interveners as to whether the plot ST-6 was a regular residential plot or it was used for amenity purposes.

The KDA land director filed a compliance report mentioning that the ST-6 plot in Block 3-A of Gulistan-e-Jauhar was reserved for the amenity purpose of the construction of a mosque. He submitted that three institutions had applied for its allotment but due to the non-existence of the allotment committee, the request for its allotment could not be granted.

The land director submitted that the documents produced by the interveners were forged and fabricated as there was no record available for them. The KDA officer submitted that the encroachment drive could not be successful due to the law and order situation as women came out and used abusive language against officers of the KDA and police.

He said that the directorate of estate and enforcement had affixed a show-cause notice on the walls directing the occupants to vacate the premises within 15 days.

A division bench of the SHC comprising Justice Irfan Saadat Khan and Justice Mohammad Faisal Kamal Alam after taking the KDA report on record directed the KDA DG to submit a report on the status of three amenity plots ST-4, ST-5, and ST-6 in Gulistan-e-Jauhar Block 3-A.

کراچی: کے ڈی اے کو سندھ ہائی کورٹ نے گلستان جوہر میں تین سہولت پلاٹوں پر رپورٹ پیش کرنے کی ہدایت کی۔

سندھ ہائی کورٹ نے کراچی ڈویلپمنٹ اتھارٹی (کے ڈی اے) کے ڈائریکٹر جنرل (ڈی جی) کو ہدایت کی ہے کہ وہ اس بات کی جانچ پڑتال کے بعد رپورٹ پیش کریں کہ آیا گلستان جوہر بلاک 3-A میں واقع تین سہولت پلاٹس سہولت کے مقاصد کے لیے استعمال ہو رہے ہیں یا نہیں۔

یہ ہدایت حال ہی میں مسجد کے مقصد کے لیے مختص پلاٹوں پر تجاوزات کے خلاف ایک درخواست پر آئی ہے۔ ہائی کورٹ نے پچھلی سماعت پر کے ڈی اے کے عہدیداروں کو کچھ مداخلت کرنے والوں کی تیار کردہ دستاویزات کی تصدیق کرنے کی بھی ہدایت کی تھی کہ آیا پلاٹ ST-6 باقاعدہ رہائشی پلاٹ ہے یا اسے سہولت کے لیے استعمال کیا گیا ہے۔

کے ڈی اے کے لینڈ ڈائریکٹر نے ایک تعمیل رپورٹ درج کی جس میں کہا گیا ہے کہ گلستان جوہر کے بلاک 3-A میں ST-6 پلاٹ مسجد کی تعمیر کے مقصد کے لیے مخصوص تھا۔ انہوں نے کہا کہ تین اداروں نے اس کی الاٹمنٹ کے لیے درخواست دی تھی لیکن الاٹمنٹ کمیٹی کے عدم موجودگی کی وجہ سے اس کی الاٹمنٹ کی درخواست منظور نہیں کی جا سکی۔

لینڈ ڈائریکٹر نے کہا کہ مداخلت کرنے والوں کی تیار کردہ دستاویزات جعلی اور من گھڑت ہیں کیونکہ ان کے لیے کوئی ریکارڈ دستیاب نہیں ہے۔ کے ڈی اے افسر نے کہا کہ امن و امان کی صورتحال کی وجہ سے تجاوزات مہم کامیاب نہیں ہو سکی کیونکہ خواتین نے باہر آ کر کے ڈی اے اور پولیس کے افسران کے خلاف نازیبا زبان استعمال کی۔ انہوں نے کہا کہ ڈائریکٹوریٹ آف اسٹیٹ اینڈ انفورسمنٹ نے دیواروں پر شوکاز نوٹس لگا دیا ہے جس میں رہائشیوں کو 15 دن کے اندر احاطہ خالی کرنے کی ہدایت کی گئی ہے۔

سندھ ہائی کورٹ کے جسٹس عرفان سعادت خان اور جسٹس محمد فیصل کمال عالم پر مشتمل ڈویژن بینچ نے کے ڈی اے کی رپورٹ آن ریکارڈ لینے کے بعد کے ڈی اے کو ڈی جی کو ہدایت کی کہ وہ تین سہولت پلاٹوں ST-4 ، ST-5 اور ST-6 گلستان جوہر بلاک 3-A کی حالت پر رپورٹ پیش کرے۔
